Christmas at the Orphanage
I had read information that Korean orphans would not get adapted here because Koreans put emphasis on the family blood line. Once I read this I was determined to try and do something nice for the orphans. I realized that even though I talk to mom every weekend and tell her that I love her, these kids can't do that. It really affected me and I knew this was something that would be rewarding for me and great for the kids. Since it was so close to christmas, I decided to find an orphanage in Boryeong.
I asked a few of my fellow foreign teachers if they would be willing to donate some money toward food and presents. My plan was to give them a pizza party and me dressed as santa clause to give out the gifts. I managed to raise 400,000 won which gave them pizza, juice and a few gifts for the group.
I dressed up as Santa Claus and with 4 of my friends, we went to the orphanage and entertained about 20 elementary level kids. There was a lot of chasing Santa Claus by the kids and fingernail painting for the girls and boys. I can tell you that Santa was worn out. At the end, the gifts were given to the kids.
A minister, who runs a local Hawgwon, donated pencil cases for all the kids and I had Tom and Jerry stickers, Snickers and Twix minis for them. Once those were given out I handed out the 5 gifts for all the kids to share. They were a Soccer ball, 2 stack-em games, a numbers bingo game, a cops and robbers board game and a table top ping pong game. The smiles we got from the kids made it the best christmas eve I had in a long time.

대한민국 충청남도교육청 교육감 (이하 “고용자”라 한다)과 국민인 원어민
(성명) (이하 “피고용자”라 한다)은 대한민국의 원어민 영어보조교사 선발ㆍ활용 사업을 위하여 다음과 같이 고용 계약을 체결한다.
This Contract of Employment (hereinafter referred to as “Contract”) is made by and entered into between the Superintendent of Chungnam Office of Education , (hereinafter referred to as “Employer”), and the Guest English Teacher (Name) (hereinafter referred to as “Employee”) a citizen of .

제1조 (목적) 이 고용계약서는 충청남도교육청 소속 중ㆍ고등학교에서 원어민 영어보조교사 선발ㆍ활용 사업의 일환으로 선발된 피고용자의 직무와 고용 조건에 관한 사항을 규정함을 목적으로 한다.
Article 1 (Purpose) This contract sets forth the terms and conditions of employment for SEPIC-GET’s who will teach in middle and high schools under the Chungnam Office of Education (CNOE).
제2조 (고용등급)
① 고용자는 피고용자를 본 계약서 서두에 명시된 등급으로 고용한다.
② 피고용자는 본 계약서 서두에 명시된 고용등급에 따른 증빙 서류를 고용자에게 제출해야 한다.
③ 본 계약서 서두에 명시된 고용 등급은 고용기간 시작일 기준으로 산정된 것이며, 고용기간 중 고용등급은 변경되지 않는다.
Article 2 (Pay Level)
① The Employee shall be hired pursuant to this Contract with the Pay Level set forth at the beginning of this contract.
② The Pay Level set forth at the beginning of this Contract will be contingent upon provision of all the necessary documentational proof of qualifications and experience required by the Employer to be eligible for said Pay Level.
③ Any new qualifications obtained after the beginning of the Term of Employment will not
subsequently change the Pay Level during the Term of Employment; the Pay Level will remain that agreed to at the beginning of the Term of Employment.
제3조 (임무) 원어민 영어보조교사로 근무하는 피고용자의 임무는 다음과 같다.
① 충청남도교육청에서 지정한 중ㆍ고등학교에서 영어를 가르친다.
② 한국인 교사와 협력 또는 주도적으로 수업을 실시한다.
③ 영어 수업 관련 자료를 제작한다.
④ 영어 교육 관련 교육자료의 개발을 보조한다.
⑤ 학교 영어 활동 및 기타 특별활동을 지원한다.
⑥ 한국인 교사 및 학생에 대한 영어 회화 교육을 실시한다.
⑦ 방학 중 각종 영어프로그램을 포함한 고용자가 지정하는 기타의 업무를 수행한다.
⑧ 원어민 교사는 학교장이나 담당 장학사, 외부방문객이 수업공개를 요구할 경우 언제라도 수업을 공개하 여야 한다.
Article 3 (Duties)
The Employee shall perform the following duties in the educational institutions of the undersigned
Office of Education for the period indicated above:
① To teach English at middle and high schools designated by Chungnam Office of Education.
② Assist Korean teachers with their English class(es) and/or jointly conduct English class(es) and/or lead English class(es);
③ Prepare teaching materials and lesson plans for English class(es);
④ Assist with the development and creation of teaching materials related to English language education;
⑤ Assist with activities related to English language education and other extracurricular activities such as but not limited to editing or creating English documents, judging contests, conducting teacher training, working at English camps, etc.;
⑥ Conduct English conversational class(es)/course(s) for Korean teachers and students; and
⑦ Perform other duties as designated by the Employer including various English programs during the school vacation period.
⑧ GET shall be available for class observation by the principal, CNOE staff, or visitors as assigned by the supervisor.
제4조 (지휘 감독)
피고용자는 고용자가 지정하는 소속기관장의 구체적인 지휘 감독을 받아 위 제3조에 정한 임무를 수행한다.
Article 4 (Supervision)
The Employee shall carry out the duties set forth in the foregoing Article 3 pursuant to and under specific instruction and supervision of the Supervisor of the Work Place designated by Employer.
제5조 (고용기간)
① 고용기간은 본 계약서의 서두에 명시된 기간으로 한다.
② 피고용자가 이유를 불문하고 최초 작성한 계약서상에 명시된 근무 시작일에 근무를 개시할 수 없는 경우, 새로운 1년 고용기간이 명시된 계약서를 한국 입국 후 재작성한다. 계약서는 근무 시작일부터 효력을 발생하며, 고용기간은 근무 시작일로부터 1년간이다.
③ 피고용자가 원어민보조교사로서 타 시ㆍ도에서의 근무 경력이 있더라도, 고용자가 변경되므로 타 시ㆍ도에서의 근무 기간이 본 고용계약 기간에 합산되지 않는다. 따라서 본 계약은 신규 고용이다.
Article 5 (Term of Employment)
① The Term of Employment shall be the period set forth at the beginning of this Contract.
② This Term of Employment is not and shall not be considered a continuation of any previous Term of Employment with a different Office of Education. Hence, the Employer shall hire the GET as a new employee.
③ If the Employee, for whatever reason, is unable to begin work on the date specified herein, the Contract shall be rewritten to indicate the new one year Term of Employment. The Contract will only take effect on the day the Employee is able to begin work and the Term of Employment shall be a one-year period beginning from that day forth.
제6조 (사직)
① 피고용자는 제5조에 규정된 고용기간동안 제3조에 명시된 임무를 수행한다.
② 그러나 만약 피고용자가 불가피하게 고용기간 중도에 사직할 경우에는 최소한 30일 전에 사직하고자 하는 일자와 사유를 서면으로 고용자에게 통보하여야 한다.
③ 피고용자가 30일 전에 사직하고자 하는 일자와 사유를 서면으로 고용자에게 통보하지 않고 일방적으로 직을 그만둘 경우, 그 사실이 출입국관리소에 통보되며 추후 피고용자의 한국 입국시 불이익을 당할 수 있다.
④ 피고용자가 사직하는 경우에 피고용자의 귀국항공료는 피고용자가 부담하며, 피고용자 비자는 취소된다.
Article 6 (Resignation)
① The Employee shall perform the duties set forth under Article 3 hereof during the Term of Employment set forth under Article 5 hereof.
② This contract is binding unless the Employee gives thirty (30) days written notice of termination (stating a planned date of resignation and reason(s) therefore) to the principal of the Employee's main school as well as the Superintendent of the Office of Education.
③ Failure of the Employee to give thirty (30) days written notice of termination to the main school Principal and the Superintendent of the Office of Education shall be reported to the Korean Immigration Service and shall affect the Employee's ability to freely enter the Republic of Korea in the future.
④ In the case of the Employee's resignation the airfare for the return home shall be borne by Employee and his/her visa shall be cancelled.
제7조 (근무지)
① 피고용자는 본 계약서의 서두에 명시된 교육청 관할의 학교, 교육청, 연수기관, 교육기관에서 근무하여야 한다.
② 고용자는 피고용자의 근무지를 복수의 기관으로 지정할 수 있다.
③ 고용자는 학교 방학기간동안 피고용자의 근무지를 교육청, 연수기관 및 교육기관에서 근무하도록 지시할 수 있다. 이 때 피고용자는 추가의 보수를 요구할 수 없다.
Article 7 (Work Place)
① The Employee shall work at any location(s) designated by the Employer. The location(s) designated by the Employer may include but are not limited to schools, Office of Education, training centers, or any other educational institutes located in the jurisdiction of the undersigned Office of Education.
② The Employer may designate multiple locations for the Employee to work.
③ The Employer may designate the Employee to work at the Office of Education, training centers or
other educational institutes during the school vacation period. In this case, the Employee shall not
claim for any additional pay if the hours of work fall under the regular Work Hours stated in
Article 8.
제8조 (근무시간)
① 피고용자는 일일 8시간, 주 5일을 근무하며, 토요일과 일요일 및 대한민국 공휴일은 근무하지 않는다.
단, 고용주가 운영하는 영어프로그램(영어캠프 등)은 일과 이외의 시간 및 주말을 포함할 수 있다. 이경
우 본조 ③항 및 ④항에 준하여 수당을 지급한다.
② 피고용자의 근무시간은 대한민국 공무원의 출퇴근 시간을 준용하되, 근무지의 소속기관장이 정하는 바
에 의해 조정할 수 있다.
③ 피고용자의 주당 실제 수업시간수는 22시간을 초과하지 않는다. 정규 시간외 수업으로 주당 실제 수업시간수가 22시간을 초과하는 경우에는 초과하는 시간에 대하여 시간외 수업수당(시간 당 20,000원)을 지급한다.
④ 소속기관장은 피고용자에게 위의 근무일 또는 근무시간 이외의 근무를 지시할 수 있다. 이 경우에는 시간외 수당(시간 당 6,000원)을 지급한다.
⑤ 소속기관장은 근무일 또는 근무시간 이외의 수업을 피고용자의 동의하에 지시할 수 있으며 본 조 ③항 에 따라 수당을 지급한다. 단, 주당 총 수업시수가 22시간을 초과하지 않을 경우에는 소속기관장이 정 한 소정의 수당을 지급한다.
Article 8 (Work Hours)
① The Employee shall work eight (8) hours per day for five (5) calendar days per week from Monday to Friday and shall not work on Saturdays, Sundays and any national holidays of the Republic of Korea. However, temporary English programs run by the Employer (e.g., English camp) may occur outside the Work Hours specified in this clause and on weekends. In this case, the Employer shall pay according to Article 8, clause ③ and ④.
② The Work Hours of the Employee may follow the normal work schedule of civil servants of the Korean Government; however, such Work Hours may be adjusted by the Employer as he/she deems appropriate within the bounds set forth in Article 8, Clause ①.
③ Actual class instruction hours of the Employee shall not exceed twenty-two (22) hours per week. If, however, the Employee's actual weekly class instruction hours exceed twenty-two (22) hours due to supplementary class instruction, the Employee shall be entitled to a supplementary class instruction pay of 20,000 won per hour.
④ The Employer may require the Employee to work non-instructional overtime hours in addition to normal Work Hours. In this case, the Employee shall be entitled to supplementary overtime pay of 6,000 won per hour.
⑤ If the Employee agrees to teach instructional hours that occur outside the Work Hours specified in Article 8, clause ① and that total more than 22 hours per week, the Employer shall pay according to Article 8, clause ③. If the Employee agrees to teach instructional hours that occur outside the Work Hours specified in Article 8, clause ① but that total less than 22 hours per week, the Employer shall have the authority to determine the appropriate supplementary overtime pay.
제9조 (그무상황부)
① 결근, 지각, 조퇴, 외출, 출장(학교방문, 인터뷰, 출입국관련 업무 등) 이 발생할 경우, 근무상황부에 기록한 후 결재를 받는다.
② 지각, 조퇴, 외출 시간을 합하여 충 8시간이면 결근 1일로 간주한다.
Article 9 (Attendance Book)
① GETs need to sign-in and obtain approval for the following matters: Absences, tardies, early leaves, unofficial leaves for personal reasons(i.e. bank, post office, etc.) and official trips(i.e. school visits, interviews, immigration, visa processing, etc.)
② The Employee's salary shall be paid on the 25th of the month. If the 25th of the month falls on a Saturday, Sunday or a national holiday, the salary shall be paid on the immediately preceding business day.
제10조 (보수)
① 피고용자의 보수는 본 계약서 서두에 명시된 금액이며, 대한민국법에 따라 소득세, 주민세, 건강보험료, 국민연금 등을 원천 징수한다.
② 보수는 매월 25일에 지급한다. 만일 이 날이 근무일이 아닌 경우에는 그 전날에 지급한다.
③ 피고용자의 근무일이 한 달이 되지 않는 경우에는 근무 개시일 또는 종료일에 따라 일할 계산으로 보수를 지급한다.
④ 피고용자가 사전 허가 없이 무단결근하였을 경우에는 결근일수만큼 일할 계산하여 보수에서 공제할 수 있다.
⑤ 피고용자는 본 계약에 규정된 보수 이외에는 일체의 다른 보수를 청구할 수 없다.
Article 10 (Salary)
① The Employee shall be paid the amount set forth at the beginning of this Contract. However, the Korean income tax, residence tax, medical insurance premium, the national pension contribution, and any other tax or deduction mandated by the various levels of government shall be deducted each month from the Employee's salary.
② The Employee's salary shall be paid on the 25th of the month. If the 25th of the month falls on a Saturday, Sunday or a national holiday, the salary shall be paid on the immediately preceding business day.
③ If the Employee has not worked all of the normal working days in a month, for whatever reason (such as sick leave, unpaid leave, etc.), the Employee's salary for that month shall be prorated for the corresponding number of days worked.
④ If the Employee should be absent from work, for whatever reason, without having obtained prior approval from the Employer, the Employee's salary for that month shall be prorated according to the corresponding number of unauthorized absent days.
⑤ The Employee shall not claim against the Employer any compensation and/or payment other than those provided for in this Contract.
제11조 (재계약)
① 제5조에서 정한 고용기간은 피고용자와 고용자간의 상호 합의에 의하여 1년 단위로 재계약할 수 있다.
② 본조 제1항의 규정에 의해 재계약을 체결하는 경우 피고용자는 고용기간 만료일 2주일 전부터 재계약 고용개시일 직전 일까지 2주간의 재계약 보상휴가를 준다. 이 재계약 보상휴가 기간은 고용기간에 포함되며, 따라서 보수가 지급된다.
③ 재계약 체결시 고용자는 피고용자에게 재계약 보상비(200만원)를 재계약 개시 후 1개월 이내에 지급한다. 재계약의 경우(그에 따른 재계약 보상비를 지급받은 경우), 피고용자는 현 고용계약 만료에 따른 출국지원비를 지급받지 않으며, 또한 본국 방문 후 한국 입국에 따른 입국지원비를 지급받지 않는다.
④ 피고용자가 재계약 개시 후 6개월 이내에 중도 사직할 경우, 피고용자는 재계약 보상비 중 70만원을 고용자에게 반환한다.
Article 11 (Renewal)
① The Term of Employment stated in Article 5 hereof may be renewed by the mutual written agreement of the Employer and the Employee provided that the renewal Term of Employment shall not exceed one (1) year.
② In the case of renewal of this Contract pursuant to the foregoing clause ①, the Employee shall be given two weeks paid leave which shall take place during the last two (2) calendar weeks prior to the end date specified under Article 5 hereof until the day immediately preceding the commencement of the renewed term. This two-week leave will be counted as part of the contract term, and, accordingly, salary will be paid as normal for these two weeks.
③ The Employer shall provide the Employee with a Contract Renewal Allowance of 2,000,000 Korean Won (KRW) within one month of the beginning of the new Term of Employment. In the case of Contract Renewal (and the payment of the subsequent Renewal Allowance), the GET shall not receive an Exit Allowance for the completion of the current Term of Employment nor shall the GET receive an Entrance Allowance for the renewal Term of Employment.
④ In case of the termination of the Renewal Contract within the first six (6) months, regardless of course or ground therefore, the Employee shall immediately pay back to the Employer 700,000 Korean Won (KRW) of the 2,000,000 Korean Won (KRW) Renewal Allowance.
제12조 (입국 지원비/출국 지원비)
① 피고용자의 입국을 지원하기 위하여 고용자는 피고용자에게 한화 1,300,000원의 입국 지원비를 고용 개시후 대여한다. (단, 입국 지원비 중 일부는 피고용자의 건강검사비로 소요된다(건강검사는 오리엔테이션 기간 중 EPIK이 지정한 병원에서 일괄적으로 실시되며, 오리엔테이션 이외의 기간에 입국한 원어민은 개별적으로 건강검진을 실시한다). (충남교육청 자체 고용 피고용자는 입국후 개별적으로 건강검진을 실시한다.)
② 사유의 여하를 불문하고 고용계약 개시일로부터 6개월 미만에 본 계약이 조기에 종료되는 경우 피고용자(재계약자 포함)는 계약종료 즉시 위 대여금을 고용자에게 반환해야 한다. 피고용자가 위 대여금을 반환하지 않을 경우, 그 사실은 출입국관리소에 통보되며 추후 피고용자의 한국 입국시 불이익을당할 수 있다. 피고용자가 고용기간 개시일로부터 6개월 이상 근무하는 경우 본 항에 의한 대여금의 상환 의무는 면제된다.
③ 피고용자가 본 계약상의 임무를 만료하면 한화 1,300,000원의 출국 지원비를 지급한다.
Article 12 (Entrance Allowance/Exit Allowance)
① Upon beginning the Term of Employment, the Employee shall receive a 1,300,000 Korean Won (KRW) Entrance Allowance. For the first six (6) months of the Term of Employment, the Entrance Allowance of 1,300,000 Korean Won (KRW) shall be considered a loan to support the Employee's entrance into Korea. (If the Employee receives a medical examination administered by EPIK, the cost of the medical examination shall be deducted from the 1,300,000 Korean Won (KRW) Entrance Allowance).(Employee hired by Chungnam Office of Education shall complete his/her medical examination on his/her own after arrival).
② In case of the termination of this Contract (including a Renewal Contract) within the first six (6) months, regardless of course or ground therefore, the Employee shall immediately pay back to the Employer the aforementioned loan. Failure of the Employee to pay back the aforementioned loan shall be reported to the Korean Immigration Service and shall affect the Employee's ability to freely enter the Republic of Korea in the future. If the Employee successfully completes more than six (6) months of the Term of Employment from the date of commencement, the obligation of the Employee to pay back the Entrance Allowance loan shall be waived by the Employer.
③ If the Employee successfully completes his/her duties set forth in this contract for the full Term of Employment specified herein, the Employee shall be entitled to an Exit allowance of 1,300,000 Korean Won (KRW) within one month of successful completion of the Term of Employment.
제13조 (주거)
① 고용자는 피고용자에게 고용자가 선정한 주거를 제공한다. 주거 형태는 임대주택, 원룸, 또는 아파트를 포함하나 이에 한정되지 않는다. 주거의 사용에 따른 제세공과금은 피고용자의 부담으로 한다.
② 피고용자의 주거가 선정될 때까지 고용자는 임시주거를 제공할 수 있다.
③ 피고용자가 본조 1항에 명시한 주거 대신 주거지원비를 지원받기를 원하는 경우 고용자는 피고용자에게 매월 한화 400,000원의 주거비를 지원한다. 이 경우 피고용자는 고용자에게 계약 시작 전에 본인의 의사를 알려야 한다.
④ 주거를 제공받을 것인지 주거비를 지원받을 것인지는 고용 개시전에 결정하며, 일단 결정한 이후에는 고용기간동안 이를 변경할 수 없다. 피고용자의 개인적인 사정으로 인한 주거 변경시 발생하는 모든 경비는 피고용자가 부담한다.
⑤ 고용자가 주거를 제공하는 경우 고용자는 침대, 식탁 및 의자, 옷장, 가스/전기렌지, 냉장고, 세탁기, 텔레비전을 포함한 가전제품 및 가구를 제공하며, 피고용자는 고용자가 제공하는 가전제품 및 가구 이외의 물품을 요구할 수 없다.
⑥ 고용자가 제공한 숙소를 사용할 경우 피고용자는 고용 계약 기간 만료일 익일까지 퇴실해야 한다.
⑦ 고용자가 제공한 숙소를 사용할 경우 피고용자는 고용 계약을 만료하고 퇴실할 시 처음 입주시와 같은 상태로 숙소를 보존하여야 하며, 피고용자가 거주한 기간 중에 발생한 건물이나 가전제품 및 가구에 대한 손상에 대하여 피고용자는 책임을 진다.
⑧ 고용주는 결혼한 부부가 동반 지원한 경우에 한하여 동반 주거를 제공할 수 있으며, 피고용자는 부부의 성(last name)이 다를 경우 ‘결혼증명서’ 등을 제출하여 혼인 상태를 입증하여야 한다.
Article 13 (Housing)
① The Employer shall provide the Employee with a single housing chosen by the Employer. Housing selected by the Employer may be a leased house, a studio-type room, an apartment, or other form of lodging deemed sufficient by the Employer. Any and all fees, charges, costs, taxes, expenses, etc. incurred in using the housing shall be borne by the Employee. Such fees may include but are not limited to hydro, gas and water utilities as well as internet and phone service as well as a maintenance fee from the landlord.
② The Employer may choose to provide temporary housing for the Employee until appropriate permanent housing can be obtained for the Employee.
③ If the Employee wants housing allowance in lieu of the single housing set forth in the foregoing ①, the Employer shall provide the Employee with 400,000 Korean Won (KRW) per month as a rent subsidy. In this case, the Employee shall notify the Employer of his/her decision to choose housing allowance before the commencement of this Contract.
④ The decision to choose the Provided Housing or the Housing Allowance shall be made prior to the beginning of the Term of Employment contained herein and, once decided, shall not be subsequently changed during the Term of Employment. Any and all costs incurred by the Employee as a result of changing Housing during the Term of Employment shall be borne by the Employee.
⑤ If the Employer provides housing to the Employee, the Employer shall provide the following appliances and furniture: a bed, table and chair, a closet, a range, a refrigerator, a washing machine, and a TV set. The Employee shall not request or demand any other appliances or furniture than those stipulated herein.
⑥ If the Employee uses the housing provided by the Employer, the Employee shall leave the housing on the day after the final day of the contract.
⑦ If the Employee uses the housing provided by the Employer, the Employee shall leave the housing in the same condition as when it was first occupied and the Employee shall be liable for any damage to the building and appliances occurring during the period occupied by the Employee.
⑧ The Employer shall provide couples housing only to married couples jointly employed by the Employer. If the couple holds different last names, they must prove their marital status with a marriage certificate or other relevant documentation.
제14조 (기타 혜택)
① 고용자는 피고용자에게 정착금 300,000원을 고용계약 첫해 1회에 한하여 지급한다.
② 고용자는 피고용자에게 국민건강보험료(피고용자 1인을 원칙으로 하되, 가족 동반 시에는 가족 국민건강보험료 포함)의 50%를 지원한다.
③ 충남 지역에서 근무하는 원어민영어보조교사에게서 지방근무보전수당을 매월 100,000원씩 지급한다.
④ 고용자는 피고용자가 2개교 근무시 (중심교 포함)매월 100,000원, 3개교 이상 근무시 매월 최대 150,000원의 순회수당을 지급한다.
⑤ 캐나다와 아일랜드를 제외한 타국적 피고용자는 소정의 서류(피고용자의 거주지국의 권한 있는 당국자가 발급하는 “거주자증명서”와 근로소득에 대하여 조세조약에 따른 “소득세 면제 신청서”)를 최초의 보수 지급전에 고용자에게 제출하면 최초 2년간 대한민국 소득세를 감면 받을 수 있다. 한국에서 이미 2년 이상 근무한 피고용자는 소득세 감면 혜택을 받을 수 없다.
⑥ 고용자는 국민연금보험료의 50%(월보수액의 약4.5%)를 피고용자에게 지원한다. 미국, 캐나다 및 호주 국적의 피고용자는 계약종료 후 한국을 떠날 때 소정의 서류를 국민연금관리공단에 제출하면 불입한 국민연금보험료를 환불 받을 수 있다.
⑦ 고용자는 피고용자가 1년 이상의 고용계약을 성실히 마치면 약 1개월의 보수에 해당하는 퇴직금을 임무 만료 후 지급하여야 한다.
⑧ 고용자는 특별한 공로가 인정되거나 특수 기관에서 근무하는 피고용자에게 특별 수당을 지급할 수 있다.
Article 14 (Benefits)
① The Employee shall be entitled to a one time Settlement Allowance of 300,000 Korean Won (KRW), when he/she first begins the contract. This Settlement Allowance will not be granted in the case of a Contract Renewal.
② On behalf of the Employee, the Employer shall provide half of the Employee's medical insurance premium pursuant to the National Medical Insurance Act of Korea. In the case of dependents of the Employee (spouse and/or children) living with him or her in Korea, the Employer shall also provide and pay the medical insurance premium for the Employee's dependents.
③ Employees working for Chungnam Province are eligible for a provincial allowance of 100,000 KRW per month.
④ In the case that the Employee is working at more than one school, the Employee shall receive a Multiple Schools Allowance of 100,000 Korean Won (KRW) for two schools or 150,000 Korean Won (KRW) for three or more schools per month.
⑤ Employees, with the exception of Canadians and Irish, shall be eligible for exemption from paying Korean income tax during the period of the first two years of Korean employment if they provide the following documents to the Employer before the first payment of salary:
1)"Residence Certificate" issued by the relevant authority of the Employee's resident country
2)“an Application for Tax Exemption" on non-resident's Korean source income provided under the Korean Tax Treaty. If the Employee has already worked more than two years in Korea, he/she shall not be eligible for tax exemption.
⑥ The Employer, on behalf of the Employee, shall provide half of the national pension plan deduction (approximately 4.5% of salary) pursuant to the National Pension Corporation Act of Korea. American, Australian or Canadian Employees are eligible for a pension distribution refund if they submit the required documents to the Korean National Pension Corporation when they leave Korea after the completion of their Contract.
⑦ The Employee shall be entitled to severance pay according to the standard formula set out by the Ministry of Labor (equivalent to approximately one month's salary), upon successful completion of the duties set out under Article 3 hereof for the entire Term of Employment set out at the beginning of the Contract.
⑧ The Employer may provide a special allowance to an employee who has made a great contribution to the Employer and/or who is determined to work at a special institute by the Employer.
제15조 (유급휴가)
① 고용자는 피고용자에게 제5조에 규정한 고용기간동안 18 근무일(학교의 경우 여름방학기간동안 8일, 겨울방학기간동안 10일, 연수기관 근무 시는 연수에 지장이 없는 기간)의 유급휴가를 주되, 원활한 업무진행을 위해 고용자는 피고용자와 협의하여 휴가시기를 조정할 수 있다.
② 이 유급휴가를 받기 위해서는 15일전에 소속기관장에게 휴가를 신청하여 승인을 받아야 한다.
③ 피고용자는 방학과 유급휴가의 차이를 숙지하여야 한다. 피고용자는 방학 기간이라 할지라도 유급 휴가나 무급 휴가를 사전 승인받은 경우가 아니라면, 정상적으로 근무하여야 한다.
④ 지각, 조퇴, 외출 및 반일연가 1회의 경우 누계시간으로 계산하며 8시간을 1일로 공제한다. 8시간 미만은 계산하지 않는다.
Article 15 (Paid Leave)
① The Employee shall be entitled to a vacation period of a total of eighteen (18) working days during the Term of the Employment set forth under Article 5 hereof. If the Employees works in a school, the Employee shall have vacation for eight (8) working days during the summer recess and ten (10) working days during the winter recess respectively; If the Employee works in a training center, the Employee shall have their vacation outside the normal training session times. If the requested vacation period interferes with the smooth operation of the regular programming of the school or institute, the Employer and the Employee shall negotiate an alternate vacation date(s).
② The Employee shall apply for and obtain the Employer's consent to take any paid leave a minimum of fifteen (15) calendar days in advance of the requested date of leave.
③ The Employee shall note the difference between school vacation and Paid Vacation days; the Employee is expected to fulfill normal working duties during the school vacation period unless the Employee has received prior approval for Paid Vacation or Unpaid Leave during the school vacation period.
④ Regardless of the number of days over which the Paid Leave falls, eight (8) accumulated hours of Paid Leave shall be counted as one day. This includes tardiness, early leave, other absences during the work day and/or half-days of Paid Leave. A total of less than eight (8) hours will not be counted.
제16조 (병가)
① 피고용자는 고용기간 중 출근할 수 없는 정도의 질환이 있을 때 근무 시간 시작 후 1시간 이내에 소속기관장의 승인을 받아 유급병가를 받을 수 있다.
② 유급병가 기간은 근무일 기준 3일 이상, 연속할 경우에는 의사의 진단서를 병가 만료 후 출근시 소속기관장에게 제출하여야 한다.
③ 피고용자의 유급 병가기간이 11일을 초과하는 경우에는 무급으로 한다.
④ 피고용자의 병가 일수 및 사유는 인사기록카드에 기록되며 고용자는 피고용자의 복무 평가 및 재계약시 근거 자료로 활용한다.
Article 16 (Sick Leave)
① The Employee shall be entitled to a paid Sick Leave in the case of any illness or injury which prevents the Employee from performing the duties herein only with the express consent of the Employer. The Employee shall notify the Employer of any absence due to sickness within one (1) hour of the beginning of the Employee's duties.
② If the Employee takes a sick leave for three(3) days or more consecutive working days, the Employee shall submit a practicing doctor's medical report to the Employer on the day the Employee returns to work.
③ If the Employee requires a Sick Leave of more than eleven (11) working days during the Term of Employment, any working days beyond the 11-day limit will be unpaid.
④ The total number of days of Sick Leave (both paid and unpaid) used by the Employee and the reasons for taking Sick Leave will be included in the Employee's Personnel Record Card, which shall be utilized by the Employer to evaluate the Employee's conduct and determine the Employee's contract renewal.
제17조 (특별휴가)
① 피고용자는 다음 각 호의 사유가 있을 경우 소속기관장의 승인을 받아 유급 특별휴가를 받을 수 있다.
1. 피고용자 본인의 결혼 7일
2. 피고용자의 부모 또는 배우자 사망 7일, 자녀 사망 5일
3. 피고용자 본인의 출산 전후를 합하여 90일. 단, 최초 60일에 한하여 보수가 지급된다.
Article 17 (Special Leave)
① The Employee may take a paid Special Leave for a number of days as set forth below for each of the following events stated herein only with the express consent of the Employer:
1. Seven (7) calendar days for the Employee's marriage.
2. Seven (7) calendar days for the death of an Employee's parent or spouse; five (5) calendar days for the death of an Employee's child.
3. In case of a female Employee, ninety (90) calendar days shall be granted for a maternity leave. In the case of maternity leave, only the first 60 days shall be paid leave; the last 30 days shall be unpaid leave.
제18조 (복무)
① 피고용자는 교사의 품위를 손상시키는 행동 또는 SEPIC 프로그램이나 고용자의 명예를 손상시키는 행동을 하여서는 아니된다.
② 피고용자는 한국인 교사에 적용되는 복무규정을 준수하여야 한다.
③ 피고용자는 고용자가 지정한 근무지 이외의 다른 기관에서 영업 행위(시간제, 과외, 온라인 수업 포함)를 할 수 없다.
④ 피고용자는 학교 및 학생 교육을 해칠 수 있는 활동을 하여서는 아니 된다.
⑤ 피고용자는 업무기간 중 지득한 비밀 등 중요 자료를 누설하거나 사적으로 이용하여서는 아니 된다.
Article 18 (Codes of Conduct)
① The Employee shall not behave in any manner which may damage or tarnish the reputation of the teaching profession in general or of the SEPIC program and the undersigned Employer in particular.
② The Employee shall observe and comply with any codes of conduct and dress applicable to Korean teachers.
③ The Employee shall not engage in any other employment (including any part-time, private or self-employment, or online instruction) during the Term of Employment set forth under Article 5 hereof.
④ The Employee shall not be involved in any activity which could cause harm to the students or be of detriment to the reputation of the school.
⑤ Employees must not disclose any confidential information about their co-workers, school or program that they have acquired during their term of employment.
제19조 (계약 해지)
① 고용자는 다음과 같은 경우에 본 계약을 해지할 수 있다.
1. 피고용자가 대한민국법을 위반하는 경우
2. 피고용자가 E-2 비자 등 적법한 비자를 소지하지 않고 근무한 경우
3. 피고용자가 계약사항을 이행하지 아니하거나, 성실하게 임무를 수행하지 않아 2회 이상 서면 경고를 받은 경우
4. 피고용자가 고용자가 지정한 근무지 이외의 다른 기관에서 영업 행위(시간제, 과외, 온라인 수업 포
함)를 한 경우
5. 피고용자가 특별한 이유 없이 근무일 기준 5일 이상 근무를 하지 않은 경우
6. 피고용자가 제출한 지원서의 내용이 사실이 아니거나 거짓이 있는 경우
7. 피고용자가 신체적, 정신적 질환 또는 만성질환(당뇨, 고혈압, 간질환, 결핵, 뇌질환, 약물중독, 알콜중독 등)이 있어 계속 근무하기 어렵다고 판단되는 경우
a. 피고용자는 고용자가 신체 및 정신과 검사를 요구하면 근무일 기준 2일 이내에 응하여야 한다.
b. 피고용자는 공교육기관 근무를 위한 신체 검사(마약, 에이즈 포함)를 국내에서 받아야 하며 고용자가 요구하면 즉시 그 결과를 알려야 한다.
8. 본 계약 제16조에서 정한 피고용자의 병가기간(유급 및 무급 포함)이 고용기간동안 총 30일을 초과하는 경우
② 본조 제1항 각호의 사유로 인하여 본 계약이 해지되는 경우 고용자는 피고용자에게 보수를 일할 계산하여 지급한다.
③ 본조 제1항 각호의 사유로 인하여 본 계약이 해지되는 경우 피고용자는 제12조 제1항에 따라 대여금을 즉시 상환하여야 한다.
④ 본조 제1항 각호의 사유로 인하여 본 계약이 해지되는 경우 고용자는 출국지원금을 지급하지 않는다. 그리고 피고용자의 비자는 취소된다.
Article 19 (Termination of the Contract)
① The employer may legally terminate or cancel this Contract upon occurrence of any one or more of the following events:
1. The Employee violates the laws of the Republic of Korea.
2. The Employee works in Korea without holding the required valid visa.
3. The Employee fails to perform or unsatisfactorily performs any of the duties stipulated in this contract. The Employer shall provide formal written notice of unsatisfactory performance to the Employee. Two written notices shall be considered sufficient grounds for Termination of the Contract.
4. The Employee engages in any other employment (including any part-time, private or self- employment or online instruction) during the Term of Employment set forth under Article 5 herein.
5. The Employee fails to perform his/her duties for more than five working days without receiving prior consent from the Employer.
6. Any of the information provided in the Employee's Application is neither true or accurate.
7. It is determined that the Employee is prevented from incapable of performing the duties set forth under Article 3 hereof for any medical reason, whether it is physical or psychological in nature, including chronic ailments such as diabetes Mellitus, high blood pressure, chronic liver disease, tuberculosis and neurological disorder, substance or alcohol addiction, etc.
a. If requested to take a physical or psychological examination by the Employer, the Employee must make themselves available within two(2) working days for the medical examination.
b. The Employee must complete a medical examination (HIV, Drug test, etc.) in Korea for the purpose of working in Korean public schools and educational institutions. If requested by the Emloyer, the Employee must submit the result to the Employer immediately.
8. The total number of days of sick leave (both paid and unpaid) used by the Employee pursuant to Article 16 hereof exceeds thirty(30) days.
② In the event of termination of this Contract pursuant to any of the provisions set forth in the foregoing clause ①, the Employer shall pay the Employee a prorated salary for the final month of work based on the number of days actually worked by the Employee.
③ In the event of termination of this Contract pursuant to any of the provisions set forth in the foregoing clause ①, the Employee shall immediately refund the loan to the Employer pursuant to Article 12 clause ①.
④ In such event, the Employer will not pay the Employee the Exit Allowance. The Employee's visa will subsequently be cancelled.
제20조 (연수 이수)
① 피고용자는 고용개시일 직전 국립국제교육원 또는 충남교육청에서 주관하는 일정기간(약 5일)의 사전연수를 이수하여야 한다.
② 사전연수 기간에 대해서는 보수가 지급되지 않는다.
③ 수시모집에 지원하여 합격한 피고용자는 본 조 ①항의 적용을 유보할 수 있다.
④ 피고용자는 고용자가 요구할 시 연수 프로그램에 참가하여야 한다.
Article 20 (Completion of Mandatory Orientation and Training)
① Employee shall complete an orientation (about 5 days) conducted by the National Institute for
International Education or Chungnam Office of Education immediately before the commencement of
the Term of Employment provided under Article 5 hereof.
② Employee will not be entitled to any compensation for the portion of the orientation.
③ Employee selected during the period outside the regular selection period shall be exempt from the foregoing ①.
④ Employee shall participate in training program(s) upon request of Employer.
제21조 (손해배상)
본건 계약의 이행 과정에서 피고용자의 과실 및 위법 행위 또는 이와 관련하여 발생된 손해는 피고용자가 고용자에게 배상하여야 한다.
Article 21 (Indemnification)
The Employee hereby agrees to indemnify, defend and hold harmless the Employer against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of or resulting from any negligent, intentional or illegal act of the Employee during the Term of Employment under this Contract.
제22조 (상•벌)
① 학생지도에 열심히 노력하여 지대한 공로가 인정된 자에게 학교장은 특별휴가를 줄 수 있다.
② 수업 또는 근무태도가 극히 불량하거나 교육청이나 관리자(협력교사, 장학사) 에게 비협조적인 자, 질서를 문란하게 한 자, 또는 SEPIC 원어민교사 복무규정을 위반한 자에 대해서는 서면 또는 구두 경고를 한다.
③ 2회 이상 서면 경고를 받은 자는 계약을 해지할 수 있다.
Article 22 (Award & Penalty)
① GETs may be awarded additional vacation days by the Principal in recognition of their work.
② GETs who are extremely insincere in conducting their classes or fail to adibe by their duties, who are not cooperative with his/her principal( co-teacher or Supervisor), who breach school orders, and who violate "SEPIC GET's Duties and Regulations" will be subject to a verbal/ written warning by the Principal or CNOE Supervisor in charge.
③ If GETs receive more than two written warning, they can be subject to contract termination.
제23조 (정보제공 동의)
피고용자는 자신의 원어민영어보조교사 지원서 및 인사기록카드에 기재된 각종 기록이 고용자 또는 정부의 통계 관리, 현 고용주와의 재계약 및 타 시도와의 신규 계약을 위한 목적으로 활용될 수 있음에 동의한다.
Article 23 (Consent to Limited Release of Information)
The Employee grants his/her consent that the information in the Employee's application form and/or Personnel Record Card may be used for the purpose of statistical data collected by the Employer and/or the Korean government, for his/her contract renewal with his/her current Employer or his/her new application to other provinces.
제24조 (준거법, 언어 및 관할)
① 본 계약 및 본 계약상의 권리 의무에 관한 사항은 대한민국법에 의하여 해석되고 결정되어진다.
② 본건 계약의 언어는 한글이며, 다른 언어로의 번역은 편의를 위한 것이다.
③ 당사자들은 본건 계약과 관련하여 발생된 분쟁을 해결하기 위하여 신의성실의 원칙에 따라 노력하여야 한다. 본건 계약과 관련하여 발생된 분쟁을 상호 원만하게 해결할 수 없을 경우에는 대한상사 중재원의 규칙에 따라 최종적으로 중재에 의해 해결된다.
④ 기타 본 계약서에 규정되지 아니한 사항은 피고용자의 의견을 수렴하여 고용자가 정한다.
Article 24 (Governing Law, Language and Venue)
① The terms of this Contract and the rights and obligations of the parties hereto shall be construed, interpreted and determined in accordance with the laws of the Republic of Korea.
② The Governing language of the Contract shall be Korean. The English translation of this Contract is offered for the purpose of convenience only.
③ If a dispute or disagreement should arise in connection with or out of this Contract, the parties hereto shall first try to resolve it in accordance with the principle of good faith. If the parties fail to mutually resolve such disputes or disagreements or come to amicable settlements, their disputes or disagreements shall be resolved by arbitration in Seoul, Korea in accordance with the Commercial Arbitration Rules of the Korean Commercial Arbitration Board.
④ Matters not explicitly stated in the Contract shall be determined by the Employer by taking the Employee's concerns into consideration.
제25조 (서명)
고용자와 피고용자는 본 계약서 말미에 기재된 날짜에 본건 계약서를 3부 작성하여 각 1부씩 보관하고, 나머지 1부는 비자 신청용으로 제출한다.
Article 25 (Signature)

제1조 (목적) 이 고용계약서는 충청남도교육청 소속 중ㆍ고등학교에서 원어민 영어보조교사 선발ㆍ활용 사업의 일환으로 선발된 피고용자의 직무와 고용 조건에 관한 사항을 규정함을 목적으로 한다.
Article 1 (Purpose) This contract sets forth the terms and conditions of employment for SEPIC-GET’s who will teach in middle and high schools under the Chungnam Office of Education (CNOE).
제2조 (고용등급)
① 고용자는 피고용자를 본 계약서 서두에 명시된 등급으로 고용한다.
② 피고용자는 본 계약서 서두에 명시된 고용등급에 따른 증빙 서류를 고용자에게 제출해야 한다.
③ 본 계약서 서두에 명시된 고용 등급은 고용기간 시작일 기준으로 산정된 것이며, 고용기간 중 고용등급은 변경되지 않는다.
Article 2 (Pay Level)
① The Employee shall be hired pursuant to this Contract with the Pay Level set forth at the beginning of this contract.
② The Pay Level set forth at the beginning of this Contract will be contingent upon provision of all the necessary documentational proof of qualifications and experience required by the Employer to be eligible for said Pay Level.
③ Any new qualifications obtained after the beginning of the Term of Employment will not
subsequently change the Pay Level during the Term of Employment; the Pay Level will remain that agreed to at the beginning of the Term of Employment.
제3조 (임무) 원어민 영어보조교사로 근무하는 피고용자의 임무는 다음과 같다.
① 충청남도교육청에서 지정한 중ㆍ고등학교에서 영어를 가르친다.
② 한국인 교사와 협력 또는 주도적으로 수업을 실시한다.
③ 영어 수업 관련 자료를 제작한다.
④ 영어 교육 관련 교육자료의 개발을 보조한다.
⑤ 학교 영어 활동 및 기타 특별활동을 지원한다.
⑥ 한국인 교사 및 학생에 대한 영어 회화 교육을 실시한다.
⑦ 방학 중 각종 영어프로그램을 포함한 고용자가 지정하는 기타의 업무를 수행한다.
⑧ 원어민 교사는 학교장이나 담당 장학사, 외부방문객이 수업공개를 요구할 경우 언제라도 수업을 공개하 여야 한다.
Article 3 (Duties)
The Employee shall perform the following duties in the educational institutions of the undersigned
Office of Education for the period indicated above:
① To teach English at middle and high schools designated by Chungnam Office of Education.
② Assist Korean teachers with their English class(es) and/or jointly conduct English class(es) and/or lead English class(es);
③ Prepare teaching materials and lesson plans for English class(es);
④ Assist with the development and creation of teaching materials related to English language education;
⑤ Assist with activities related to English language education and other extracurricular activities such as but not limited to editing or creating English documents, judging contests, conducting teacher training, working at English camps, etc.;
⑥ Conduct English conversational class(es)/course(s) for Korean teachers and students; and
⑦ Perform other duties as designated by the Employer including various English programs during the school vacation period.
⑧ GET shall be available for class observation by the principal, CNOE staff, or visitors as assigned by the supervisor.
제4조 (지휘 감독)
피고용자는 고용자가 지정하는 소속기관장의 구체적인 지휘 감독을 받아 위 제3조에 정한 임무를 수행한다.
Article 4 (Supervision)
The Employee shall carry out the duties set forth in the foregoing Article 3 pursuant to and under specific instruction and supervision of the Supervisor of the Work Place designated by Employer.
제5조 (고용기간)
① 고용기간은 본 계약서의 서두에 명시된 기간으로 한다.
② 피고용자가 이유를 불문하고 최초 작성한 계약서상에 명시된 근무 시작일에 근무를 개시할 수 없는 경우, 새로운 1년 고용기간이 명시된 계약서를 한국 입국 후 재작성한다. 계약서는 근무 시작일부터 효력을 발생하며, 고용기간은 근무 시작일로부터 1년간이다.
③ 피고용자가 원어민보조교사로서 타 시ㆍ도에서의 근무 경력이 있더라도, 고용자가 변경되므로 타 시ㆍ도에서의 근무 기간이 본 고용계약 기간에 합산되지 않는다. 따라서 본 계약은 신규 고용이다.
Article 5 (Term of Employment)
① The Term of Employment shall be the period set forth at the beginning of this Contract.
② This Term of Employment is not and shall not be considered a continuation of any previous Term of Employment with a different Office of Education. Hence, the Employer shall hire the GET as a new employee.
③ If the Employee, for whatever reason, is unable to begin work on the date specified herein, the Contract shall be rewritten to indicate the new one year Term of Employment. The Contract will only take effect on the day the Employee is able to begin work and the Term of Employment shall be a one-year period beginning from that day forth.
제6조 (사직)
① 피고용자는 제5조에 규정된 고용기간동안 제3조에 명시된 임무를 수행한다.
② 그러나 만약 피고용자가 불가피하게 고용기간 중도에 사직할 경우에는 최소한 30일 전에 사직하고자 하는 일자와 사유를 서면으로 고용자에게 통보하여야 한다.
③ 피고용자가 30일 전에 사직하고자 하는 일자와 사유를 서면으로 고용자에게 통보하지 않고 일방적으로 직을 그만둘 경우, 그 사실이 출입국관리소에 통보되며 추후 피고용자의 한국 입국시 불이익을 당할 수 있다.
④ 피고용자가 사직하는 경우에 피고용자의 귀국항공료는 피고용자가 부담하며, 피고용자 비자는 취소된다.
Article 6 (Resignation)
① The Employee shall perform the duties set forth under Article 3 hereof during the Term of Employment set forth under Article 5 hereof.
② This contract is binding unless the Employee gives thirty (30) days written notice of termination (stating a planned date of resignation and reason(s) therefore) to the principal of the Employee's main school as well as the Superintendent of the Office of Education.
③ Failure of the Employee to give thirty (30) days written notice of termination to the main school Principal and the Superintendent of the Office of Education shall be reported to the Korean Immigration Service and shall affect the Employee's ability to freely enter the Republic of Korea in the future.
④ In the case of the Employee's resignation the airfare for the return home shall be borne by Employee and his/her visa shall be cancelled.
제7조 (근무지)
① 피고용자는 본 계약서의 서두에 명시된 교육청 관할의 학교, 교육청, 연수기관, 교육기관에서 근무하여야 한다.
② 고용자는 피고용자의 근무지를 복수의 기관으로 지정할 수 있다.
③ 고용자는 학교 방학기간동안 피고용자의 근무지를 교육청, 연수기관 및 교육기관에서 근무하도록 지시할 수 있다. 이 때 피고용자는 추가의 보수를 요구할 수 없다.
Article 7 (Work Place)
① The Employee shall work at any location(s) designated by the Employer. The location(s) designated by the Employer may include but are not limited to schools, Office of Education, training centers, or any other educational institutes located in the jurisdiction of the undersigned Office of Education.
② The Employer may designate multiple locations for the Employee to work.
③ The Employer may designate the Employee to work at the Office of Education, training centers or
other educational institutes during the school vacation period. In this case, the Employee shall not
claim for any additional pay if the hours of work fall under the regular Work Hours stated in
Article 8.
제8조 (근무시간)
① 피고용자는 일일 8시간, 주 5일을 근무하며, 토요일과 일요일 및 대한민국 공휴일은 근무하지 않는다.
단, 고용주가 운영하는 영어프로그램(영어캠프 등)은 일과 이외의 시간 및 주말을 포함할 수 있다. 이경
우 본조 ③항 및 ④항에 준하여 수당을 지급한다.
② 피고용자의 근무시간은 대한민국 공무원의 출퇴근 시간을 준용하되, 근무지의 소속기관장이 정하는 바
에 의해 조정할 수 있다.
③ 피고용자의 주당 실제 수업시간수는 22시간을 초과하지 않는다. 정규 시간외 수업으로 주당 실제 수업시간수가 22시간을 초과하는 경우에는 초과하는 시간에 대하여 시간외 수업수당(시간 당 20,000원)을 지급한다.
④ 소속기관장은 피고용자에게 위의 근무일 또는 근무시간 이외의 근무를 지시할 수 있다. 이 경우에는 시간외 수당(시간 당 6,000원)을 지급한다.
⑤ 소속기관장은 근무일 또는 근무시간 이외의 수업을 피고용자의 동의하에 지시할 수 있으며 본 조 ③항 에 따라 수당을 지급한다. 단, 주당 총 수업시수가 22시간을 초과하지 않을 경우에는 소속기관장이 정 한 소정의 수당을 지급한다.
Article 8 (Work Hours)
① The Employee shall work eight (8) hours per day for five (5) calendar days per week from Monday to Friday and shall not work on Saturdays, Sundays and any national holidays of the Republic of Korea. However, temporary English programs run by the Employer (e.g., English camp) may occur outside the Work Hours specified in this clause and on weekends. In this case, the Employer shall pay according to Article 8, clause ③ and ④.
② The Work Hours of the Employee may follow the normal work schedule of civil servants of the Korean Government; however, such Work Hours may be adjusted by the Employer as he/she deems appropriate within the bounds set forth in Article 8, Clause ①.
③ Actual class instruction hours of the Employee shall not exceed twenty-two (22) hours per week. If, however, the Employee's actual weekly class instruction hours exceed twenty-two (22) hours due to supplementary class instruction, the Employee shall be entitled to a supplementary class instruction pay of 20,000 won per hour.
④ The Employer may require the Employee to work non-instructional overtime hours in addition to normal Work Hours. In this case, the Employee shall be entitled to supplementary overtime pay of 6,000 won per hour.
⑤ If the Employee agrees to teach instructional hours that occur outside the Work Hours specified in Article 8, clause ① and that total more than 22 hours per week, the Employer shall pay according to Article 8, clause ③. If the Employee agrees to teach instructional hours that occur outside the Work Hours specified in Article 8, clause ① but that total less than 22 hours per week, the Employer shall have the authority to determine the appropriate supplementary overtime pay.
제9조 (그무상황부)
① 결근, 지각, 조퇴, 외출, 출장(학교방문, 인터뷰, 출입국관련 업무 등) 이 발생할 경우, 근무상황부에 기록한 후 결재를 받는다.
② 지각, 조퇴, 외출 시간을 합하여 충 8시간이면 결근 1일로 간주한다.
Article 9 (Attendance Book)
① GETs need to sign-in and obtain approval for the following matters: Absences, tardies, early leaves, unofficial leaves for personal reasons(i.e. bank, post office, etc.) and official trips(i.e. school visits, interviews, immigration, visa processing, etc.)
② The Employee's salary shall be paid on the 25th of the month. If the 25th of the month falls on a Saturday, Sunday or a national holiday, the salary shall be paid on the immediately preceding business day.
제10조 (보수)
① 피고용자의 보수는 본 계약서 서두에 명시된 금액이며, 대한민국법에 따라 소득세, 주민세, 건강보험료, 국민연금 등을 원천 징수한다.
② 보수는 매월 25일에 지급한다. 만일 이 날이 근무일이 아닌 경우에는 그 전날에 지급한다.
③ 피고용자의 근무일이 한 달이 되지 않는 경우에는 근무 개시일 또는 종료일에 따라 일할 계산으로 보수를 지급한다.
④ 피고용자가 사전 허가 없이 무단결근하였을 경우에는 결근일수만큼 일할 계산하여 보수에서 공제할 수 있다.
⑤ 피고용자는 본 계약에 규정된 보수 이외에는 일체의 다른 보수를 청구할 수 없다.
Article 10 (Salary)
① The Employee shall be paid the amount set forth at the beginning of this Contract. However, the Korean income tax, residence tax, medical insurance premium, the national pension contribution, and any other tax or deduction mandated by the various levels of government shall be deducted each month from the Employee's salary.
② The Employee's salary shall be paid on the 25th of the month. If the 25th of the month falls on a Saturday, Sunday or a national holiday, the salary shall be paid on the immediately preceding business day.
③ If the Employee has not worked all of the normal working days in a month, for whatever reason (such as sick leave, unpaid leave, etc.), the Employee's salary for that month shall be prorated for the corresponding number of days worked.
④ If the Employee should be absent from work, for whatever reason, without having obtained prior approval from the Employer, the Employee's salary for that month shall be prorated according to the corresponding number of unauthorized absent days.
⑤ The Employee shall not claim against the Employer any compensation and/or payment other than those provided for in this Contract.
제11조 (재계약)
① 제5조에서 정한 고용기간은 피고용자와 고용자간의 상호 합의에 의하여 1년 단위로 재계약할 수 있다.
② 본조 제1항의 규정에 의해 재계약을 체결하는 경우 피고용자는 고용기간 만료일 2주일 전부터 재계약 고용개시일 직전 일까지 2주간의 재계약 보상휴가를 준다. 이 재계약 보상휴가 기간은 고용기간에 포함되며, 따라서 보수가 지급된다.
③ 재계약 체결시 고용자는 피고용자에게 재계약 보상비(200만원)를 재계약 개시 후 1개월 이내에 지급한다. 재계약의 경우(그에 따른 재계약 보상비를 지급받은 경우), 피고용자는 현 고용계약 만료에 따른 출국지원비를 지급받지 않으며, 또한 본국 방문 후 한국 입국에 따른 입국지원비를 지급받지 않는다.
④ 피고용자가 재계약 개시 후 6개월 이내에 중도 사직할 경우, 피고용자는 재계약 보상비 중 70만원을 고용자에게 반환한다.
Article 11 (Renewal)
① The Term of Employment stated in Article 5 hereof may be renewed by the mutual written agreement of the Employer and the Employee provided that the renewal Term of Employment shall not exceed one (1) year.
② In the case of renewal of this Contract pursuant to the foregoing clause ①, the Employee shall be given two weeks paid leave which shall take place during the last two (2) calendar weeks prior to the end date specified under Article 5 hereof until the day immediately preceding the commencement of the renewed term. This two-week leave will be counted as part of the contract term, and, accordingly, salary will be paid as normal for these two weeks.
③ The Employer shall provide the Employee with a Contract Renewal Allowance of 2,000,000 Korean Won (KRW) within one month of the beginning of the new Term of Employment. In the case of Contract Renewal (and the payment of the subsequent Renewal Allowance), the GET shall not receive an Exit Allowance for the completion of the current Term of Employment nor shall the GET receive an Entrance Allowance for the renewal Term of Employment.
④ In case of the termination of the Renewal Contract within the first six (6) months, regardless of course or ground therefore, the Employee shall immediately pay back to the Employer 700,000 Korean Won (KRW) of the 2,000,000 Korean Won (KRW) Renewal Allowance.
제12조 (입국 지원비/출국 지원비)
① 피고용자의 입국을 지원하기 위하여 고용자는 피고용자에게 한화 1,300,000원의 입국 지원비를 고용 개시후 대여한다. (단, 입국 지원비 중 일부는 피고용자의 건강검사비로 소요된다(건강검사는 오리엔테이션 기간 중 EPIK이 지정한 병원에서 일괄적으로 실시되며, 오리엔테이션 이외의 기간에 입국한 원어민은 개별적으로 건강검진을 실시한다). (충남교육청 자체 고용 피고용자는 입국후 개별적으로 건강검진을 실시한다.)
② 사유의 여하를 불문하고 고용계약 개시일로부터 6개월 미만에 본 계약이 조기에 종료되는 경우 피고용자(재계약자 포함)는 계약종료 즉시 위 대여금을 고용자에게 반환해야 한다. 피고용자가 위 대여금을 반환하지 않을 경우, 그 사실은 출입국관리소에 통보되며 추후 피고용자의 한국 입국시 불이익을당할 수 있다. 피고용자가 고용기간 개시일로부터 6개월 이상 근무하는 경우 본 항에 의한 대여금의 상환 의무는 면제된다.
③ 피고용자가 본 계약상의 임무를 만료하면 한화 1,300,000원의 출국 지원비를 지급한다.
Article 12 (Entrance Allowance/Exit Allowance)
① Upon beginning the Term of Employment, the Employee shall receive a 1,300,000 Korean Won (KRW) Entrance Allowance. For the first six (6) months of the Term of Employment, the Entrance Allowance of 1,300,000 Korean Won (KRW) shall be considered a loan to support the Employee's entrance into Korea. (If the Employee receives a medical examination administered by EPIK, the cost of the medical examination shall be deducted from the 1,300,000 Korean Won (KRW) Entrance Allowance).(Employee hired by Chungnam Office of Education shall complete his/her medical examination on his/her own after arrival).
② In case of the termination of this Contract (including a Renewal Contract) within the first six (6) months, regardless of course or ground therefore, the Employee shall immediately pay back to the Employer the aforementioned loan. Failure of the Employee to pay back the aforementioned loan shall be reported to the Korean Immigration Service and shall affect the Employee's ability to freely enter the Republic of Korea in the future. If the Employee successfully completes more than six (6) months of the Term of Employment from the date of commencement, the obligation of the Employee to pay back the Entrance Allowance loan shall be waived by the Employer.
③ If the Employee successfully completes his/her duties set forth in this contract for the full Term of Employment specified herein, the Employee shall be entitled to an Exit allowance of 1,300,000 Korean Won (KRW) within one month of successful completion of the Term of Employment.
제13조 (주거)
① 고용자는 피고용자에게 고용자가 선정한 주거를 제공한다. 주거 형태는 임대주택, 원룸, 또는 아파트를 포함하나 이에 한정되지 않는다. 주거의 사용에 따른 제세공과금은 피고용자의 부담으로 한다.
② 피고용자의 주거가 선정될 때까지 고용자는 임시주거를 제공할 수 있다.
③ 피고용자가 본조 1항에 명시한 주거 대신 주거지원비를 지원받기를 원하는 경우 고용자는 피고용자에게 매월 한화 400,000원의 주거비를 지원한다. 이 경우 피고용자는 고용자에게 계약 시작 전에 본인의 의사를 알려야 한다.
④ 주거를 제공받을 것인지 주거비를 지원받을 것인지는 고용 개시전에 결정하며, 일단 결정한 이후에는 고용기간동안 이를 변경할 수 없다. 피고용자의 개인적인 사정으로 인한 주거 변경시 발생하는 모든 경비는 피고용자가 부담한다.
⑤ 고용자가 주거를 제공하는 경우 고용자는 침대, 식탁 및 의자, 옷장, 가스/전기렌지, 냉장고, 세탁기, 텔레비전을 포함한 가전제품 및 가구를 제공하며, 피고용자는 고용자가 제공하는 가전제품 및 가구 이외의 물품을 요구할 수 없다.
⑥ 고용자가 제공한 숙소를 사용할 경우 피고용자는 고용 계약 기간 만료일 익일까지 퇴실해야 한다.
⑦ 고용자가 제공한 숙소를 사용할 경우 피고용자는 고용 계약을 만료하고 퇴실할 시 처음 입주시와 같은 상태로 숙소를 보존하여야 하며, 피고용자가 거주한 기간 중에 발생한 건물이나 가전제품 및 가구에 대한 손상에 대하여 피고용자는 책임을 진다.
⑧ 고용주는 결혼한 부부가 동반 지원한 경우에 한하여 동반 주거를 제공할 수 있으며, 피고용자는 부부의 성(last name)이 다를 경우 ‘결혼증명서’ 등을 제출하여 혼인 상태를 입증하여야 한다.
Article 13 (Housing)
① The Employer shall provide the Employee with a single housing chosen by the Employer. Housing selected by the Employer may be a leased house, a studio-type room, an apartment, or other form of lodging deemed sufficient by the Employer. Any and all fees, charges, costs, taxes, expenses, etc. incurred in using the housing shall be borne by the Employee. Such fees may include but are not limited to hydro, gas and water utilities as well as internet and phone service as well as a maintenance fee from the landlord.
② The Employer may choose to provide temporary housing for the Employee until appropriate permanent housing can be obtained for the Employee.
③ If the Employee wants housing allowance in lieu of the single housing set forth in the foregoing ①, the Employer shall provide the Employee with 400,000 Korean Won (KRW) per month as a rent subsidy. In this case, the Employee shall notify the Employer of his/her decision to choose housing allowance before the commencement of this Contract.
④ The decision to choose the Provided Housing or the Housing Allowance shall be made prior to the beginning of the Term of Employment contained herein and, once decided, shall not be subsequently changed during the Term of Employment. Any and all costs incurred by the Employee as a result of changing Housing during the Term of Employment shall be borne by the Employee.
⑤ If the Employer provides housing to the Employee, the Employer shall provide the following appliances and furniture: a bed, table and chair, a closet, a range, a refrigerator, a washing machine, and a TV set. The Employee shall not request or demand any other appliances or furniture than those stipulated herein.
⑥ If the Employee uses the housing provided by the Employer, the Employee shall leave the housing on the day after the final day of the contract.
⑦ If the Employee uses the housing provided by the Employer, the Employee shall leave the housing in the same condition as when it was first occupied and the Employee shall be liable for any damage to the building and appliances occurring during the period occupied by the Employee.
⑧ The Employer shall provide couples housing only to married couples jointly employed by the Employer. If the couple holds different last names, they must prove their marital status with a marriage certificate or other relevant documentation.
제14조 (기타 혜택)
① 고용자는 피고용자에게 정착금 300,000원을 고용계약 첫해 1회에 한하여 지급한다.
② 고용자는 피고용자에게 국민건강보험료(피고용자 1인을 원칙으로 하되, 가족 동반 시에는 가족 국민건강보험료 포함)의 50%를 지원한다.
③ 충남 지역에서 근무하는 원어민영어보조교사에게서 지방근무보전수당을 매월 100,000원씩 지급한다.
④ 고용자는 피고용자가 2개교 근무시 (중심교 포함)매월 100,000원, 3개교 이상 근무시 매월 최대 150,000원의 순회수당을 지급한다.
⑤ 캐나다와 아일랜드를 제외한 타국적 피고용자는 소정의 서류(피고용자의 거주지국의 권한 있는 당국자가 발급하는 “거주자증명서”와 근로소득에 대하여 조세조약에 따른 “소득세 면제 신청서”)를 최초의 보수 지급전에 고용자에게 제출하면 최초 2년간 대한민국 소득세를 감면 받을 수 있다. 한국에서 이미 2년 이상 근무한 피고용자는 소득세 감면 혜택을 받을 수 없다.
⑥ 고용자는 국민연금보험료의 50%(월보수액의 약4.5%)를 피고용자에게 지원한다. 미국, 캐나다 및 호주 국적의 피고용자는 계약종료 후 한국을 떠날 때 소정의 서류를 국민연금관리공단에 제출하면 불입한 국민연금보험료를 환불 받을 수 있다.
⑦ 고용자는 피고용자가 1년 이상의 고용계약을 성실히 마치면 약 1개월의 보수에 해당하는 퇴직금을 임무 만료 후 지급하여야 한다.
⑧ 고용자는 특별한 공로가 인정되거나 특수 기관에서 근무하는 피고용자에게 특별 수당을 지급할 수 있다.
Article 14 (Benefits)
① The Employee shall be entitled to a one time Settlement Allowance of 300,000 Korean Won (KRW), when he/she first begins the contract. This Settlement Allowance will not be granted in the case of a Contract Renewal.
② On behalf of the Employee, the Employer shall provide half of the Employee's medical insurance premium pursuant to the National Medical Insurance Act of Korea. In the case of dependents of the Employee (spouse and/or children) living with him or her in Korea, the Employer shall also provide and pay the medical insurance premium for the Employee's dependents.
③ Employees working for Chungnam Province are eligible for a provincial allowance of 100,000 KRW per month.
④ In the case that the Employee is working at more than one school, the Employee shall receive a Multiple Schools Allowance of 100,000 Korean Won (KRW) for two schools or 150,000 Korean Won (KRW) for three or more schools per month.
⑤ Employees, with the exception of Canadians and Irish, shall be eligible for exemption from paying Korean income tax during the period of the first two years of Korean employment if they provide the following documents to the Employer before the first payment of salary:
1)"Residence Certificate" issued by the relevant authority of the Employee's resident country
2)“an Application for Tax Exemption" on non-resident's Korean source income provided under the Korean Tax Treaty. If the Employee has already worked more than two years in Korea, he/she shall not be eligible for tax exemption.
⑥ The Employer, on behalf of the Employee, shall provide half of the national pension plan deduction (approximately 4.5% of salary) pursuant to the National Pension Corporation Act of Korea. American, Australian or Canadian Employees are eligible for a pension distribution refund if they submit the required documents to the Korean National Pension Corporation when they leave Korea after the completion of their Contract.
⑦ The Employee shall be entitled to severance pay according to the standard formula set out by the Ministry of Labor (equivalent to approximately one month's salary), upon successful completion of the duties set out under Article 3 hereof for the entire Term of Employment set out at the beginning of the Contract.
⑧ The Employer may provide a special allowance to an employee who has made a great contribution to the Employer and/or who is determined to work at a special institute by the Employer.
제15조 (유급휴가)
① 고용자는 피고용자에게 제5조에 규정한 고용기간동안 18 근무일(학교의 경우 여름방학기간동안 8일, 겨울방학기간동안 10일, 연수기관 근무 시는 연수에 지장이 없는 기간)의 유급휴가를 주되, 원활한 업무진행을 위해 고용자는 피고용자와 협의하여 휴가시기를 조정할 수 있다.
② 이 유급휴가를 받기 위해서는 15일전에 소속기관장에게 휴가를 신청하여 승인을 받아야 한다.
③ 피고용자는 방학과 유급휴가의 차이를 숙지하여야 한다. 피고용자는 방학 기간이라 할지라도 유급 휴가나 무급 휴가를 사전 승인받은 경우가 아니라면, 정상적으로 근무하여야 한다.
④ 지각, 조퇴, 외출 및 반일연가 1회의 경우 누계시간으로 계산하며 8시간을 1일로 공제한다. 8시간 미만은 계산하지 않는다.
Article 15 (Paid Leave)
① The Employee shall be entitled to a vacation period of a total of eighteen (18) working days during the Term of the Employment set forth under Article 5 hereof. If the Employees works in a school, the Employee shall have vacation for eight (8) working days during the summer recess and ten (10) working days during the winter recess respectively; If the Employee works in a training center, the Employee shall have their vacation outside the normal training session times. If the requested vacation period interferes with the smooth operation of the regular programming of the school or institute, the Employer and the Employee shall negotiate an alternate vacation date(s).
② The Employee shall apply for and obtain the Employer's consent to take any paid leave a minimum of fifteen (15) calendar days in advance of the requested date of leave.
③ The Employee shall note the difference between school vacation and Paid Vacation days; the Employee is expected to fulfill normal working duties during the school vacation period unless the Employee has received prior approval for Paid Vacation or Unpaid Leave during the school vacation period.
④ Regardless of the number of days over which the Paid Leave falls, eight (8) accumulated hours of Paid Leave shall be counted as one day. This includes tardiness, early leave, other absences during the work day and/or half-days of Paid Leave. A total of less than eight (8) hours will not be counted.
제16조 (병가)
① 피고용자는 고용기간 중 출근할 수 없는 정도의 질환이 있을 때 근무 시간 시작 후 1시간 이내에 소속기관장의 승인을 받아 유급병가를 받을 수 있다.
② 유급병가 기간은 근무일 기준 3일 이상, 연속할 경우에는 의사의 진단서를 병가 만료 후 출근시 소속기관장에게 제출하여야 한다.
③ 피고용자의 유급 병가기간이 11일을 초과하는 경우에는 무급으로 한다.
④ 피고용자의 병가 일수 및 사유는 인사기록카드에 기록되며 고용자는 피고용자의 복무 평가 및 재계약시 근거 자료로 활용한다.
Article 16 (Sick Leave)
① The Employee shall be entitled to a paid Sick Leave in the case of any illness or injury which prevents the Employee from performing the duties herein only with the express consent of the Employer. The Employee shall notify the Employer of any absence due to sickness within one (1) hour of the beginning of the Employee's duties.
② If the Employee takes a sick leave for three(3) days or more consecutive working days, the Employee shall submit a practicing doctor's medical report to the Employer on the day the Employee returns to work.
③ If the Employee requires a Sick Leave of more than eleven (11) working days during the Term of Employment, any working days beyond the 11-day limit will be unpaid.
④ The total number of days of Sick Leave (both paid and unpaid) used by the Employee and the reasons for taking Sick Leave will be included in the Employee's Personnel Record Card, which shall be utilized by the Employer to evaluate the Employee's conduct and determine the Employee's contract renewal.
제17조 (특별휴가)
① 피고용자는 다음 각 호의 사유가 있을 경우 소속기관장의 승인을 받아 유급 특별휴가를 받을 수 있다.
1. 피고용자 본인의 결혼 7일
2. 피고용자의 부모 또는 배우자 사망 7일, 자녀 사망 5일
3. 피고용자 본인의 출산 전후를 합하여 90일. 단, 최초 60일에 한하여 보수가 지급된다.
Article 17 (Special Leave)
① The Employee may take a paid Special Leave for a number of days as set forth below for each of the following events stated herein only with the express consent of the Employer:
1. Seven (7) calendar days for the Employee's marriage.
2. Seven (7) calendar days for the death of an Employee's parent or spouse; five (5) calendar days for the death of an Employee's child.
3. In case of a female Employee, ninety (90) calendar days shall be granted for a maternity leave. In the case of maternity leave, only the first 60 days shall be paid leave; the last 30 days shall be unpaid leave.
제18조 (복무)
① 피고용자는 교사의 품위를 손상시키는 행동 또는 SEPIC 프로그램이나 고용자의 명예를 손상시키는 행동을 하여서는 아니된다.
② 피고용자는 한국인 교사에 적용되는 복무규정을 준수하여야 한다.
③ 피고용자는 고용자가 지정한 근무지 이외의 다른 기관에서 영업 행위(시간제, 과외, 온라인 수업 포함)를 할 수 없다.
④ 피고용자는 학교 및 학생 교육을 해칠 수 있는 활동을 하여서는 아니 된다.
⑤ 피고용자는 업무기간 중 지득한 비밀 등 중요 자료를 누설하거나 사적으로 이용하여서는 아니 된다.
Article 18 (Codes of Conduct)
① The Employee shall not behave in any manner which may damage or tarnish the reputation of the teaching profession in general or of the SEPIC program and the undersigned Employer in particular.
② The Employee shall observe and comply with any codes of conduct and dress applicable to Korean teachers.
③ The Employee shall not engage in any other employment (including any part-time, private or self-employment, or online instruction) during the Term of Employment set forth under Article 5 hereof.
④ The Employee shall not be involved in any activity which could cause harm to the students or be of detriment to the reputation of the school.
⑤ Employees must not disclose any confidential information about their co-workers, school or program that they have acquired during their term of employment.
제19조 (계약 해지)
① 고용자는 다음과 같은 경우에 본 계약을 해지할 수 있다.
1. 피고용자가 대한민국법을 위반하는 경우
2. 피고용자가 E-2 비자 등 적법한 비자를 소지하지 않고 근무한 경우
3. 피고용자가 계약사항을 이행하지 아니하거나, 성실하게 임무를 수행하지 않아 2회 이상 서면 경고를 받은 경우
4. 피고용자가 고용자가 지정한 근무지 이외의 다른 기관에서 영업 행위(시간제, 과외, 온라인 수업 포
함)를 한 경우
5. 피고용자가 특별한 이유 없이 근무일 기준 5일 이상 근무를 하지 않은 경우
6. 피고용자가 제출한 지원서의 내용이 사실이 아니거나 거짓이 있는 경우
7. 피고용자가 신체적, 정신적 질환 또는 만성질환(당뇨, 고혈압, 간질환, 결핵, 뇌질환, 약물중독, 알콜중독 등)이 있어 계속 근무하기 어렵다고 판단되는 경우
a. 피고용자는 고용자가 신체 및 정신과 검사를 요구하면 근무일 기준 2일 이내에 응하여야 한다.
b. 피고용자는 공교육기관 근무를 위한 신체 검사(마약, 에이즈 포함)를 국내에서 받아야 하며 고용자가 요구하면 즉시 그 결과를 알려야 한다.
8. 본 계약 제16조에서 정한 피고용자의 병가기간(유급 및 무급 포함)이 고용기간동안 총 30일을 초과하는 경우
② 본조 제1항 각호의 사유로 인하여 본 계약이 해지되는 경우 고용자는 피고용자에게 보수를 일할 계산하여 지급한다.
③ 본조 제1항 각호의 사유로 인하여 본 계약이 해지되는 경우 피고용자는 제12조 제1항에 따라 대여금을 즉시 상환하여야 한다.
④ 본조 제1항 각호의 사유로 인하여 본 계약이 해지되는 경우 고용자는 출국지원금을 지급하지 않는다. 그리고 피고용자의 비자는 취소된다.
Article 19 (Termination of the Contract)
① The employer may legally terminate or cancel this Contract upon occurrence of any one or more of the following events:
1. The Employee violates the laws of the Republic of Korea.
2. The Employee works in Korea without holding the required valid visa.
3. The Employee fails to perform or unsatisfactorily performs any of the duties stipulated in this contract. The Employer shall provide formal written notice of unsatisfactory performance to the Employee. Two written notices shall be considered sufficient grounds for Termination of the Contract.
4. The Employee engages in any other employment (including any part-time, private or self- employment or online instruction) during the Term of Employment set forth under Article 5 herein.
5. The Employee fails to perform his/her duties for more than five working days without receiving prior consent from the Employer.
6. Any of the information provided in the Employee's Application is neither true or accurate.
7. It is determined that the Employee is prevented from incapable of performing the duties set forth under Article 3 hereof for any medical reason, whether it is physical or psychological in nature, including chronic ailments such as diabetes Mellitus, high blood pressure, chronic liver disease, tuberculosis and neurological disorder, substance or alcohol addiction, etc.
a. If requested to take a physical or psychological examination by the Employer, the Employee must make themselves available within two(2) working days for the medical examination.
b. The Employee must complete a medical examination (HIV, Drug test, etc.) in Korea for the purpose of working in Korean public schools and educational institutions. If requested by the Emloyer, the Employee must submit the result to the Employer immediately.
8. The total number of days of sick leave (both paid and unpaid) used by the Employee pursuant to Article 16 hereof exceeds thirty(30) days.
② In the event of termination of this Contract pursuant to any of the provisions set forth in the foregoing clause ①, the Employer shall pay the Employee a prorated salary for the final month of work based on the number of days actually worked by the Employee.
③ In the event of termination of this Contract pursuant to any of the provisions set forth in the foregoing clause ①, the Employee shall immediately refund the loan to the Employer pursuant to Article 12 clause ①.
④ In such event, the Employer will not pay the Employee the Exit Allowance. The Employee's visa will subsequently be cancelled.
제20조 (연수 이수)
① 피고용자는 고용개시일 직전 국립국제교육원 또는 충남교육청에서 주관하는 일정기간(약 5일)의 사전연수를 이수하여야 한다.
② 사전연수 기간에 대해서는 보수가 지급되지 않는다.
③ 수시모집에 지원하여 합격한 피고용자는 본 조 ①항의 적용을 유보할 수 있다.
④ 피고용자는 고용자가 요구할 시 연수 프로그램에 참가하여야 한다.
Article 20 (Completion of Mandatory Orientation and Training)
① Employee shall complete an orientation (about 5 days) conducted by the National Institute for
International Education or Chungnam Office of Education immediately before the commencement of
the Term of Employment provided under Article 5 hereof.
② Employee will not be entitled to any compensation for the portion of the orientation.
③ Employee selected during the period outside the regular selection period shall be exempt from the foregoing ①.
④ Employee shall participate in training program(s) upon request of Employer.
제21조 (손해배상)
본건 계약의 이행 과정에서 피고용자의 과실 및 위법 행위 또는 이와 관련하여 발생된 손해는 피고용자가 고용자에게 배상하여야 한다.
Article 21 (Indemnification)
The Employee hereby agrees to indemnify, defend and hold harmless the Employer against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of or resulting from any negligent, intentional or illegal act of the Employee during the Term of Employment under this Contract.
제22조 (상•벌)
① 학생지도에 열심히 노력하여 지대한 공로가 인정된 자에게 학교장은 특별휴가를 줄 수 있다.
② 수업 또는 근무태도가 극히 불량하거나 교육청이나 관리자(협력교사, 장학사) 에게 비협조적인 자, 질서를 문란하게 한 자, 또는 SEPIC 원어민교사 복무규정을 위반한 자에 대해서는 서면 또는 구두 경고를 한다.
③ 2회 이상 서면 경고를 받은 자는 계약을 해지할 수 있다.
Article 22 (Award & Penalty)
① GETs may be awarded additional vacation days by the Principal in recognition of their work.
② GETs who are extremely insincere in conducting their classes or fail to adibe by their duties, who are not cooperative with his/her principal( co-teacher or Supervisor), who breach school orders, and who violate "SEPIC GET's Duties and Regulations" will be subject to a verbal/ written warning by the Principal or CNOE Supervisor in charge.
③ If GETs receive more than two written warning, they can be subject to contract termination.
제23조 (정보제공 동의)
피고용자는 자신의 원어민영어보조교사 지원서 및 인사기록카드에 기재된 각종 기록이 고용자 또는 정부의 통계 관리, 현 고용주와의 재계약 및 타 시도와의 신규 계약을 위한 목적으로 활용될 수 있음에 동의한다.
Article 23 (Consent to Limited Release of Information)
The Employee grants his/her consent that the information in the Employee's application form and/or Personnel Record Card may be used for the purpose of statistical data collected by the Employer and/or the Korean government, for his/her contract renewal with his/her current Employer or his/her new application to other provinces.
제24조 (준거법, 언어 및 관할)
① 본 계약 및 본 계약상의 권리 의무에 관한 사항은 대한민국법에 의하여 해석되고 결정되어진다.
② 본건 계약의 언어는 한글이며, 다른 언어로의 번역은 편의를 위한 것이다.
③ 당사자들은 본건 계약과 관련하여 발생된 분쟁을 해결하기 위하여 신의성실의 원칙에 따라 노력하여야 한다. 본건 계약과 관련하여 발생된 분쟁을 상호 원만하게 해결할 수 없을 경우에는 대한상사 중재원의 규칙에 따라 최종적으로 중재에 의해 해결된다.
④ 기타 본 계약서에 규정되지 아니한 사항은 피고용자의 의견을 수렴하여 고용자가 정한다.
Article 24 (Governing Law, Language and Venue)
① The terms of this Contract and the rights and obligations of the parties hereto shall be construed, interpreted and determined in accordance with the laws of the Republic of Korea.
② The Governing language of the Contract shall be Korean. The English translation of this Contract is offered for the purpose of convenience only.
③ If a dispute or disagreement should arise in connection with or out of this Contract, the parties hereto shall first try to resolve it in accordance with the principle of good faith. If the parties fail to mutually resolve such disputes or disagreements or come to amicable settlements, their disputes or disagreements shall be resolved by arbitration in Seoul, Korea in accordance with the Commercial Arbitration Rules of the Korean Commercial Arbitration Board.
④ Matters not explicitly stated in the Contract shall be determined by the Employer by taking the Employee's concerns into consideration.
제25조 (서명)
고용자와 피고용자는 본 계약서 말미에 기재된 날짜에 본건 계약서를 3부 작성하여 각 1부씩 보관하고, 나머지 1부는 비자 신청용으로 제출한다.

GETs Cultural Activities
Adjusting to a new culture and getting along with the local people are two common challenges for nearly everyone who lives and works abroad. That is why Chungnam Office of Education holds a Cultural Tour for GETs every semester.
The purpose is to be able to appreciate Korean culture more than they do now with their limited exposure.
Chungnam GETs experienced to talked with people they don't know, experienced a new place and experienced how Korean people live. They mixed-up their life with Korean culture for few days. Through this activity Chungnam GETs admire Korean culture a lot.

The 2009 English Up Contest
English Up Contest is one of the biggest and important event in Chungnam province with a full support from the Superintendent of Chungnam Education Board. This year the contest was held at Hanso University. Actually this is a kind of contest that many students from Chungnam want to join.
EPIK-Chungnam native English teachers prepared their students before the contest within a month. And some of them went to the place just to give support to their students. Selected native English teachers from Hanso University and some of the province best teachers were selected to be one of the judges.
The purpose of the contest is :
■ To support achievement in the study of English language
■ To promote proficiency in interpretive communication in English language
■ To assess the students standard as they pertain to learning English
■ To stimulate further interest in learning English
GETs In Service Training
About 30 native English teachers joined the 3rd Chungnam In Service Training program last summer vacation. Native English teachers shared ideas and gave advice with each other on how to be more effective in the classroom.
Supervisors, co teachers and other invited GETs watched them during their presentation. Mr. Gong Soon Taek, the In-charge Supervisor for the native English teachers gave lecture on how to be an effective teacher in Korean classroom.

Chungnam Epic Reunion
It was an Epic reunion indeed, complete with special effects and
hordes of unruly native English teachers waiting to be brought to
order. The days were cold and snow capped – I think we all felt a
subzero as we clamoured onto buses and trains, responding to the
promise of yet another adventure in Korea. We were not disappointed,
like our very first orientation meeting it turned out to be a
fulfilling experience. It doesn’t often happen that such a diverse
group of people are thrown together like a batch of ill-matched
ingredients in a mixing bowl and produce outstanding results.
It was clear from the initial introduction – Mr gong and Racquel were
looking for exceptional people when they conducted the interviews.
Having mostly come from different industries and having no prior
teaching experience, we were all belly flopping into a stream with
scant hope of floating let alone riding the current.
But what I saw last week was testament not only to the fact that we
have some great swimmers but that some are individuals with great
talent for teaching. On the first day, after brief introductions we
were all allocated rooms then taken through the time table. It took a
while to get settled but as soon as lunch was over we got straight
into the presentations. A few peers spoke to us about their personal
experiences, giving us their insight into daily life and teaching in
Korea. Others gave examples of lessons that had worked well and shared
some advice on issues such as discipline and cultural differences.
I found it to be a very rewarding encounter, as many of the topics
covered were matters which I had been struggling with throughout the
year. The greater thing being that one of my fellow teachers who was
presenting even took some time out afterwards to answer more of my
questions. Some thorny issues were raised and met with much
resistance. Although when tempers cooled, it really brought to light
how much Mr Gong had fought for all the native teachers in Chungnam.
Many people got a chance to express their opinions and share ideas.
Most of us agreed that this was a very helpfull workshop with the
suggestion that it rather take place in the middle of the year.

Dear Raquel, When I returned to my home in Gyeryong City after the reunion in Asan, I spent the next morning reviewing the materials presented by the SEPIC teachers. During the following week, I began to focus on the following year of teaching and the methods and materials that I will use. Goal: I want the students, grade 1 and 2 to speak English during class time 85% of the class time. Last year I experimented with many formats to help the students engage with me and with one another in English. My aim was for them to speak, 90% in English during class. The results varied by class (I have 20 different classes per week), but in the beginning stages, the average was closer to 75% as many students would "slip" easily in to speaking Korean. I found that, when I selected truly relatable and interesting topics, the students found their own MOTOVATION. It was not always easy to find these areas of interest. As time went on, the topics that inspired them to chat (in English) became more obvious. I have discovered that on the high school level motivation can be decisive as the students are very busy with many subjects. I need to catch their imagination and their inspiration, quickly! The most interesting information from the seminar for me was the list of successful resources that speakers shared with us. They shared successful and specific motivational material that they personally experienced with their students and methods of delivering this material. Murdockreferred the class to

I am writing this letter in regards to the reunion event that was held on December 17th and 18th. This event was by far the best event that I have been to as a SEPIC teacher. I can further say that this made me feel that my efforts were really appreciated. During the experience I got see many faces of individuals that I met almost a year ago. We all could share are different but similar encounters that we had while teaching as a SEPIC teacher. Some of us shared are experiences through presentations which we were aloud to ask questions, and comment on. This was really great because we got to learn from each other on how to deal with different situations. Others shared some of their experiences on a more personal level. All of which were truly moving because it made us realize we were not alone with the challenges we all seem to face in our day to day teaching. It also made us feel more like a family, sense we are all alone here that is really important. It is very hard for us being from a different culture and not having any family or friends to talk to. So it is times like these that can make things less challenging on our time here. They also add great motivation to become a better teacher and aspire us to stay here longer. I really feel that more events like this could help us learn more and allow us to share ideas on making our time here more meaningful in all aspect. Most of us came with little or no teaching experience so we need workshops to aid us in our development and this was perfect. With out training and support most of us feel desperate for feedback and ideas, and at the reunion this is exactly what we got many different concepts and real feedback. I was happy to have gotten the chance to attend it and be acknowledged as a SEPIC teacher trying to make a difference.

Back Together Again;
My 2009 SEPIC Reunion Experience

The first annual SEPIC Reunion of 2009 was a complete success in my opinion. It was great to see all the people that I had orientation with- in that same place almost a year before- and discuss and talk about our experiences teaching in Korea together. I thought the presentations given by teachers were great and drummed up interesting and important dialogs. The discussions allowed the teachers to complain, praise, and share common experiences, while learning and gaining new knowledge and insights about teaching in Korea.
The snow fell on the institute in Asan during our two day stay there, painting the landscape in a beautiful white glaze. Many of the teachers there were from South Africa and had never seen snow before. For them, this experience was especially special. I remember before my presentation a snowball fight broke out, which lightened the mood and reaffirmed our preexisting knowledge that we were indeed in a different country and environment. That night we sang songs in the nora bang and had some drinks to relax.
The following day we had a couple more presentations then made our way to a private collection of historical Korean textiles, arts, and valuables in a museum in Asan. It was a great experience as well. Mr. Gong narrated much of the tour and another snowball fight broke out outside between some SEPICs and some middle-school aged children. I can't really say who won because both sides were wearing their fair share amount of snow. Then we ate a traditional Korean duck lunch at a restaurant and watched the snow fall on the mountains outside as we drank, laughed, and shared stories about Korea.
I left the 2009 SEPIC Reunion with a heightened sense of pride for the SEPIC program, Korea, and for my job here; teaching English. If there is another reunion next year, count me in!
